Primarily for our Business clients, we offer personal legal services to provide you with peace of mind.

We can assist you with Wills and Powers of Attorney, creation and compliance of Family Trusts and documenting Relationship property and Property-sharing arrangements. 

Enduring Powers of Attorney EPOAs) are legal documents allowing you to appoint a third party to make decisions on your behalf if you become incapacitated or unable to do so yourself.

There are two different types of EPOA:

  1. Property; and

  2. Personal Care and Welfare (addressing medical matters).

 

You and your de facto partner, spouse or civil partner may assume they will be able to make decisions for you, however in many instances this is not the case. Further, many rest homes now require legally valid EPOAs to be in place before admitting a resident.

EPOAs must be drafted in accordance with strict legal guidelines and prepared by a lawyer. 

Life is unpredictable and none of us know what might around the corner. 

If you die without a valid will you could be placing stress on your family, who will already be grieving.

you should look to update your will.

You should also update your will whenever your circumstances change, for example:

  • Buying a property;

  • Getting married;

  • Having a baby;

  • Getting separated; or

  • going into business.    

We offer a Wills-on-Wheels service and  will come to a place convenient for you for document execution, within the Wellington region.

Family Trusts have been New Zealanders' primary "go-to" for asset protection, in one form or another, for over 400 years!

They are as valuable today if the underlying Trust Deed is drafted robustly and flexibly, and is fit for your purposes.

A Family Trust is not right for everyone and we can assist you in determining whether one is right for you.

 

The Property (Relationships) Act governs relationship property in New Zealand, unless you have "contracted out" of the Act and put in place their own contractual arrangements that will apply instead. 

We can assist with:

  • Pre-nuptial (Relationship Property) Agreements;

  • Property Sharing Agreement; and

  • Establishing a Trust to protect your separate property.
